Seller Policy

This Seller Policy applies to every person or business approved to sell through Micro Motors Swap Meet (the Marketplace). The Marketplace is operated by Ramen Cat. By applying for a seller account, creating a listing or completing a sale, you agree to this policy and any other marketplace terms shown to you.

Nothing in this policy excludes, restricts or modifies any right or obligation that cannot lawfully be excluded, including rights and obligations under the Australian Consumer Law.

1. How the Marketplace works

  • Unless a listing clearly identifies Ramen Cat or Micro Motors as the seller, the sale is directly between the approved seller and the buyer.
  • The seller is responsible for the listing, stock, pricing, fulfilment, customer service, returns and legal compliance relating to their products or services.
  • Seller or listing approval is not an endorsement or guarantee. Ramen Cat may review listings, help facilitate disputes and take action to protect the community.

2. Who can sell

  • You must be at least 18 years old, legally able to enter contracts and entitled to sell every item you list.
  • You must provide accurate identity, contact, payment and payout information, complete any Stripe verification, and state whether you sell privately or as a business.
  • Business sellers must provide an ABN or other business information if requested.
  • You are responsible for account security and must promptly report suspected unauthorised use.
  • Approval is personal to the approved seller and cannot be transferred or sold.

3. What can be listed

Approved categories include diecast vehicles, decals and graphics, custom parts, wheels and tyres, displays, dioramas, storage products and approved collector services.

You must not list:

  • stolen goods or anything you do not own or have authority to sell;
  • counterfeit products or reproductions presented as genuine;
  • recalled, unsafe, illegal, hazardous or prohibited goods;
  • items or content that infringe intellectual-property, privacy or publicity rights;
  • misleading, discriminatory, abusive or otherwise harmful products or services; or
  • anything outside the approved marketplace categories unless Ramen Cat gives written permission.

Sellers of custom decals, graphics and parts must own the relevant rights or have permission to use them. Unofficial or custom-made products must be described clearly and must not imply endorsement by a vehicle manufacturer, toy brand, artist or rights holder.

4. Listing standards

  • Use clear, current photos of the actual item and show material defects, damage, missing pieces and packaging condition.
  • State the brand, model, scale, condition, modifications, authenticity, quantity and included accessories accurately.
  • For carded diecast, describe the card, blister and vehicle separately. Do not hide creases, cracks, reseals or restoration work.
  • Keep stock and availability current and remove or deactivate an item promptly if it is no longer available.
  • State handling time, location, postage or pickup options, tracking availability and any seller return terms.
  • Use accurate AUD pricing. Include GST where applicable and disclose delivery or other permitted charges clearly. Do not use fake discounts, misleading comparisons or hidden fees.

5. Private and business sellers

Business sellers must comply with the Australian Consumer Law, including applicable consumer guarantees, product-safety obligations and remedies such as repair, replacement or refund. A seller return policy operates in addition to any rights that cannot be excluded.

Some consumer guarantees may not apply to genuine one-off private sales. However, private sellers must still have the right to sell the item, provide undisturbed ownership, disclose any hidden debt or charge, and avoid false or misleading representations. All sellers must comply with applicable law.

6. Fees, payments, payouts and tax

  • Joining and creating a listing are currently free.
  • A 5% Micro Motors platform fee applies when an item sells. Stripe payment-processing fees are separate.
  • Payouts are processed through Stripe and may be affected by Stripe verification, processing periods, refunds, disputes, chargebacks or lawful holds.
  • Sellers must not use the Marketplace to avoid fees or direct a buyer to an off-platform payment for an item first found through the Marketplace.
  • Each seller is responsible for their own tax, GST, record-keeping and reporting obligations.

7. Orders, postage and pickup

  • An accepted order is a commitment to supply the item as described at the agreed price.
  • Dispatch within the handling time stated in the listing, use protective packaging suitable for collectibles and provide tracking when promised.
  • Do not mark an order as dispatched until it has actually been handed to the carrier.
  • Keep proof of postage and communicate promptly about delays, loss, damage or inability to fulfil an order.
  • For local pickup, agree on a safe location and do not publish a private residential address in a public listing.

8. Returns, refunds and disputes

  • The seller is the buyer’s first point of contact for product, delivery, return and refund issues.
  • Sellers must respond promptly and provide any remedy required by law or by the listing’s stated terms.
  • Ramen Cat may request evidence, facilitate communication, remove a listing, restrict an account or take other reasonable platform action. This does not replace or limit legal rights.
  • Refunds and chargebacks may be processed through Stripe and may be deducted from current or future seller payouts where permitted.

9. Community conduct

  • Communicate honestly and respectfully. Harassment, threats, discrimination, fraud and abusive conduct are not permitted.
  • Do not manipulate reviews, create sham transactions, spam users, misuse another person’s account or maintain duplicate accounts to avoid enforcement.
  • Keep marketplace communication and payments within the approved platform tools unless Ramen Cat authorises otherwise.

10. Buyer information and privacy

Use buyer personal information only to fulfil the order, provide customer service, meet legal obligations or resolve a dispute. Keep it secure, do not sell or disclose it unnecessarily, and do not use it for marketing without valid consent. Report any suspected loss, unauthorised access or disclosure to Ramen Cat promptly.

11. Listing content and intellectual property

You retain ownership of content you create. By submitting listing content, you give Ramen Cat and Micro Motors a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize and display it for operating and promoting the Marketplace. You confirm that you have the rights needed to grant this licence.

Ramen Cat may remove or restrict content that is reported or reasonably believed to infringe rights. Sellers must cooperate with authenticity and intellectual-property enquiries.

12. Enforcement

Ramen Cat may approve or reject seller applications, review or remove listings, suspend or close accounts, cancel platform access, hold or offset payouts where permitted, and cooperate with payment providers or authorities. Action may be taken for safety concerns, fraud risk, repeated complaints, chargebacks, policy breaches or legal requirements.

Account closure does not remove obligations relating to completed sales, refunds, disputes, chargebacks, fees, taxes or legal compliance.

13. Changes to this policy

Ramen Cat may update this policy as the Marketplace develops or legal and operational requirements change. The updated effective date will appear at the top of the page. Continued use after an update means you accept the revised policy, subject to any rights that cannot be excluded.
